Terms of Service

These Terms of Service (“Terms”) govern your use of the AEMS hosted platform (“Department plan”) operated by AEMS (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you are accepting these Terms on behalf of an organisation, you represent that you have authority to bind that organisation.

1. The Service

AEMS provides an AI-assisted exam marking platform that allows educators to upload exam submissions, apply marking schemes, review AI-proposed annotations, and publish grades to a learning management system. The Service is provided “as is” and may be updated from time to time.

2. Accounts and access

  • You must provide a valid email address to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must not share account access or API tokens with unauthorised individuals.
  • We may suspend or terminate accounts that violate these Terms or applicable law.

3. Acceptable use

You agree to use the Service only for lawful educational purposes. You must not:

  • Upload content that violates any law or regulation.
  • Attempt to circumvent security controls, rate limits, or access restrictions.
  • Use the Service to harass, discriminate against, or harm students or colleagues.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Resell or sublicense access to the Service without written authorisation.

4. Your data

You retain ownership of all content you upload to the Service, including exam PDFs, marking schemes, and grading results. We do not claim any intellectual property rights over your content.

You grant us a limited licence to process your content solely for the purpose of providing the Service (e.g., sending submissions to AI providers for marking, storing results, and delivering feedback via Canvas LMS).

We do not use your content to train AI models or for any purpose beyond operating the Service on your behalf. See our Privacy Policy for full data handling details.

5. AI-assisted marking

The Service uses AI models to propose marks and generate annotations. These proposals are suggestions only. The educator is solely responsible for reviewing, approving, and publishing all grades. AEMS does not guarantee the accuracy of AI-generated assessments and is not liable for grading decisions made by the user.

6. Trial and payment

  • New workspaces begin with a 14-day free trial with full functionality.
  • After the trial period, a paid subscription is required to continue using the Service.
  • Payments are processed via Stripe. Pricing and billing terms are displayed at checkout.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • Refunds are handled on a case-by-case basis. Contact us within 14 days of payment for billing issues.

7. Service availability

We aim to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by circumstances beyond our reasonable control (internet outages, third-party provider failures, force majeure).

8. Limitation of liability

To the maximum extent permitted by law, AEMS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold AEMS harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

  • You may cancel your subscription and close your account at any time via the in-app settings.
  • Upon termination, your data will be retained for 30 days (to allow re-activation or export), then permanently deleted.
  • We may terminate your account immediately if you materially breach these Terms.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of Sweden. Any disputes shall be resolved in the courts of Sweden, unless otherwise required by mandatory consumer protection law.
